New Appeals Judge For Special Court for Sierra Leone

Justice Jon Kamanda was sworn in today as Justice of the Special Court ’s Appeals Chamber. The Appeals Chamber of the Special Court for Sierra Leone is set to have the appeals hearing in the AFRC trials from Monday 12th November at 10:30 A.M. On the 19th July 2007 , Trial Chamber II of the Special Court Special Court Special Court Special Court for Sierra Leone (SCSL) issued the Court’s first sentences in the case of alleged Armed Forces Revolutionary Counsel (AFRC) leaders Alex Tamba Brima, Brima Bazzy Kamara and Santigie Kanu. The judgement sentenced Brima and Kanu to fifty years in prison and Kamara to forty-five years with credit for the time they were detained pending trial.

 

Pursuant to both Articles. 20 of the Statute and Rule 106, both the Prosecution and Defence may appeal the judgment on the basis of procedural error, an error in a question of law invalidating the decision, or an error of fact that   has occasioned a miscarriage of justice. By Rule 108, a party seeking to appeal a judgment must file an appeal with the registrar and serve a written notice of appeal upon the other party within fourteen days of the judgment. In considering the Trial Chamber’s judgment, the Appeals Chamber may affirm, reverse or revise.
